Terms & Conditions

1. Scope of Application

These Terms & Conditions apply to all services and offerings provided by ouichef guide. The ouichef guide is a project operated by Johannes Unterkofler e.U. (trading as apoint media). They govern all paid restaurant listings on www.ouichefguide.com, as well as related services including social media features, newsletter mentions, and content production.

These Terms & Conditions are directed exclusively at businesses ("Unternehmer" within the meaning of § 1 KSchG) — restaurants, hotels and other commercial venues entering into a listing agreement in the course of their trade or profession. They are not intended for consumers. As the customer is acting as a business, no statutory consumer right of withdrawal ("Rücktrittsrecht" under the Austrian Fern- und Auswärtsgeschäfte-Gesetz) applies to contracts concluded under these Terms.

2. General Use of the Website

This section applies to anyone visiting or using www.ouichefguide.com, regardless of whether they hold a paid listing.

Permission is granted to view and browse the materials on ouichefguide.com for personal, non-commercial use. This is a licence, not a transfer of title, and under it you may not: modify or copy the materials; use them for any commercial purpose or public display; attempt to decompile or reverse-engineer any software on the site; remove any copyright or proprietary notice; or transfer the materials to another person or mirror them on another server. This licence terminates automatically if you breach any of these restrictions.

Content on the site — restaurant descriptions, editorial articles, photography and the map data — is provided on an "as is" basis. We make reasonable efforts to keep listings and articles accurate but do not warrant the completeness, accuracy or reliability of any material, including details supplied by third parties such as listed restaurants. To the extent permitted by law, we are not liable for damages arising from the use of, or inability to use, the site's content.

The site may link to third-party websites not operated by us. We are not responsible for the content or privacy practices of those sites.

3. Services

3.1 Essential Listing (€150/year)

  • Listing on the ouichef website
  • Placement on the interactive map
  • Inclusion in editorial themes (where applicable)
  • Permanent SEO-optimized backlink
  • Use of the official ouichef guide seal

3.2 Visibility Boost (€250/year)

Includes all features from Essential Listing, plus:

  • Instagram welcome story
  • Two Instagram carousel posts
  • Placement in Instagram country highlights
  • Access to the Member's Club newsletter & early editorial opportunities

3.3 Spotlight Premium (€450/year)

Includes all features from Visibility Boost, plus:

  • Two additional Instagram stories
  • One high-quality Instagram reel (produced or submitted)
  • Blog article with SEO backlink
  • Editorial recommendation on Instagram & the website

3.4 Publication

Listings are only published after all required information has been submitted and payment has been received in full.

4. Duration & Renewal

All packages are valid for 12 months from the date of publication. All paid packages renew automatically for another 12 months at a fixed renewal rate of €150, regardless of the originally selected package, unless cancelled in writing at least 14 days prior to the renewal date. Cancellations can be made informally via email to office@ouichefguide.com.

Note: ouichef may send a renewal reminder, but is not obligated to do so.

5. Payment Terms

  • All packages must be paid in advance.
  • Invoices are issued digitally.
  • In case of delayed payment, ouichef reserves the right to pause or remove the listing, and to charge default interest at the statutory rate for business-to-business transactions under § 456 UGB (currently 9.2 percentage points above the base rate), plus a lump sum of €40 for collection costs under § 458 UGB.

6. Content & Obligations of the Restaurant

  • The restaurant confirms that all submitted content (texts, images, logos, etc.) is free from third-party rights.
  • ouichef may edit, shorten, or curate content for editorial quality and consistency.
  • The restaurant is responsible for the accuracy of all submitted information.

7. Intellectual Property & Usage Rights

By submitting content, the restaurant grants ouichef a non-exclusive, unrestricted right to use the material on the website, social media, newsletter and other digital/print formats. The ouichef guide seal may only be used by restaurants with an active paid package.

8. Editorial Freedom & Updates

ouichef reserves the right to adapt the design, structure or editorial layout of the guide at any time, provided the core features of the booked package remain available. There is no entitlement to specific placement, exposure or publication timing.

9. Liability

ouichef makes no guarantees regarding bookings, reach or financial return. Liability for slight negligence is excluded to the extent permitted by law; liability for intent and gross negligence, and for personal injury, remains unaffected. Where liability is not excluded, it is limited to the amount paid by the restaurant for the service giving rise to the claim in the twelve months preceding the event.

10. Data Protection

Our privacy policy can be found at www.ouichefguide.com/privacy-policy. All data is used solely for onboarding, communication, and delivery of the booked package.

11. Email Communication Consent

By agreeing to be listed in the ouichef guide, the restaurant consents to being contacted by ouichef via email. This includes, but is not limited to, editorial updates, campaign notifications, product announcements, and relevant opportunities. The restaurant may opt out of such communications at any time via email.

12. Final Provisions

ouichef may revise these Terms & Conditions at any time; the version published on this page at the time of a given order governs that order. Austrian law applies, excluding its conflict-of-law rules and the UN Convention on Contracts for the International Sale of Goods. Place of jurisdiction is Salzburg, Austria, where legally permissible. If any part of these T&Cs is found to be invalid, the remainder shall remain in effect.
